Rule 41A of the Uniform Rules of Court

Rule 41A of the Uniform Rules of Court makes it a mandatory requirement as a pre-action for litigants to consider mediation when instituting any new action or application proceedings.

 

In a Judge President`s Practise directive dated 21 July 2021 Judge President EM Makgoba stated that from 1 September 2021; “the court will decline to hear the matter, but strike some from the role, where the rule has not been complied with.
